Guidance has recently been published by The Presidents of the Employment Tribunals in England & Wales and in Scotland confirming substantial increases to the award for ‘injury to feelings’.
Injury to feelings is an award that is given by the Employment Tribunal in relation to successful discrimination cases lodged by employees and is in recognition for the hurt or upset suffered by them because of the discriminatory act. This is commonly awarded in addition to the compensation for loss of earnings, of which is uncapped.
These injury to feelings awards (also known as the ‘Vento Bands’), have been increased taking into account the high level of inflation in the last year, with effect from 06.04.2023 to:
Lower band: £1,100 to £11,200
Middle band: £11,200 to £33,700
Upper band: £33,700 to £56,200
Exceptional cases: awards may exceed £56,200
